Assistance to detainees

The lawyer also explains the detainee's rights, such as the right to remain silent or to receive a medical examination, and verifies that the detention is carried out legally. Assault offenses

The crime of bodily harm refers to when a person intentionally causes physical or mental harm to another, impacting the victim's health or well-being. This type of crime includes situations where someone strikes, injures, or inflicts any kind of physical suffering that requires medical attention, such as cuts, fractures, or bruises. Depending on the severity of the injuries, penalties may vary; for instance, minor injuries might lead to a fine, while more serious harm could result in a prison sentence.

 

Thefts, petty theft and fraud

Crimes of theft, larceny, and fraud are different ways of taking something that belongs to someone else without their consent, each with its own characteristics. Larceny occurs when someone takes an item without using violence or intimidation, such as stealing an unattended wallet. Theft is more serious because, in addition to taking someone else's property, the person uses force or threat, as in the case of a robbery. Fraud, on the other hand, involves deceiving someone to obtain their money or assets; an example would be convincing someone to invest in a fake business. Although all three crimes involve taking someone else's property, they differ in how they are committed and in the severity of the act.

 

Domestic violence - gender violence

Domestic violence and gender-based violence are forms of abuse that happen within close relationships, though they have important differences. Domestic violence includes any kind of abuse between family members, which may occur between parents and children, siblings, or even elderly family members. Gender-based violence, however, specifically refers to violence suffered by a person within a couple (or ex-couple) relationship due to their being a woman, driven by motives of control and superiority over the female gender. This type of violence can take multiple forms and, in many countries, receives special legal attention to protect victims and prevent these abuses.

 

Minor defense

Child protection refers to the set of laws and measures designed to safeguard the rights and well-being of children and adolescents. This includes ensuring that they have access to adequate education, healthcare, a safe and loving environment, and that their opinions and feelings are respected. When a minor is in a risky situation, such as abuse, neglect, or family problems, child protection seeks to intervene to ensure their safety and well-being. This may involve the action of social services, intervention by courts, or the assignment of legal guardians to ensure that the child receives the care and support they need. Child protection is an effort to create a safe and healthy environment for children and adolescents to grow and develop properly.

 

Alcohol-related offenses - crimes against traffic safety

Alcohol tests are conducted to measure the amount of alcohol in a person's blood, especially in the context of driving vehicles, and they are crucial for preventing accidents and ensuring road safety. When a person drives under the influence of alcohol, they endanger not only their own life but also the lives of other drivers and pedestrians. In many countries, laws establish blood alcohol limits to ensure safety on the roads. If someone is stopped and their alcohol level exceeds the legal limit, they may be charged with a traffic safety offense, which can result in fines, loss of points on their driver's license, and even imprisonment in serious or repeat cases.

 

Penitentiary law

Penitentiary law is the body of rules that regulate the organization, operation, and administration of penitentiary institutions, as well as the enforcement of custodial sentences. Its purpose is to ensure that individuals deprived of their liberty are treated with dignity and humanity and to promote their social reintegration once they have served their sentences.

Penitentiary law is closely related to criminal law and human rights. In this regard, the enforcement of custodial sentences must adhere to international human rights standards and the penal and procedural regulations applicable in each country.

 

Minor offenses

Minor offenses are infractions that, although considered illegal, are deemed less serious compared to more severe crimes. These may include actions such as stealing low-value items, causing minor damage to property, or showing disrespect towards authority. Generally, the penalties associated with minor offenses are less severe and typically involve fines or administrative sanctions instead of prison sentences. Often, individuals accused of minor offenses have the opportunity to resolve the matter through agreements or reparations, meaning they do not always face a lengthy trial.
